A High Court judge has granted a final injunction to Westminster Council preventing any further demolition works or other unauthorised development on the site of a historic public house in Maida Vale.
A High Court judge has granted a final injunction to Westminster Council preventing any further demolition works or other unauthorised development on the site of a historic public house in Maida Vale.
The public house, the Carlton Tavern, was substantially demolished last year, shortly prior to it being expected to be recommended for listing by Heritage England.
Westminster subsequently issued an enforcement notice requiring Carlton Terrace to be rebuilt. Some remaining walls and other parts of Carlton Tavern are still in situ and evidence was received by the local authority that further demolition works were imminent.
Westminster obtained an urgent interim injunction in July 2015. Mrs Justice McGowan has now granted a final injunction confirming the terms of the interim order and awarding the council its costs.
An appeal against the enforcement notice and refusal of an earlier planning application will be determined later in 2016.
Saira Kabir Sheikh QC of Francis Taylor Building acted for Westminster in the injunction proceedings. She is also representing the council in the forthcoming appeals.
